Bosch ProPartner pilot website Privacy STATEMENT

1. Robert Bosch Tool Corporation (“Bosch”, “we” or “us”) is pleased to have you (“you” or “your” or “Pilot Participant”) as an authorized agent for Pilot Participant use of the Bosch websites collectively known as the Bosch ProPartner Pilot Website (“Pilot Website”) and the related services provided through the Bosch Pilot Website (the “Alpha and Beta Services”), or services related thereto, for the Pilot Participant. This privacy statement (this “Privacy Statement”) applies to users of the Bosch Pilot Website and the Alpha and Beta Services, anywhere in the United States, its territories and possessions. Terms capitalized but not defined in this Privacy Statement are as defined in the Robert Bosch Tool Corporation ProPartner Terms of Use (the “Terms”).

2. Bosch respects your privacy

The protection of Pilot Participant’s privacy in the processing of its personal data is an important concern to which we pay special attention. We process personal data collected during your visit to the Pilot Website and use of the Alpha and Beta Services in compliance with this Privacy Statement. Data protection and information security are part of Bosch corporate policy.

3. Collection and processing of personal data

Personal data is only stored when given by you or collected from you in your access to and/or use of the Pilot Website and/or the Alpha and Beta Services, for example, in context of registering Pilot Participant’s ProPartner account on the Pilot Website, requesting service for a Bosch tool through the Pilot Website or tracking a Bosch tool submitted by Pilot Participant for service through the Pilot Website or when you contact customer support or otherwise interact or communicate with Bosch through the Pilot Website. This information may include, without limitation, your first and last name, mailing address, physical address, job title, email address, phone number(s), fax number, repair order information, repair transaction details, call and SMS data (for services in which there are communications between users), jobsite locations, warehouse locations and any other information you choose to provide us or which is otherwise collected as a part of Pilot Participant’s access to and/or use of use of the Pilot Website and/or the Alpha and Beta Services, or services related thereto.

4. Use of personal data and purpose specification

Bosch or the entities or individuals specified in Sharing of Personal Data below may use your personal data for the purpose of:

• technical administration of Bosch and Bosch affiliate websites, mobile applications and/or services

• customer, vendor, licensor and/or supplier administration, review and/or reports

• administering, maintaining, personalizing and improving Bosch and Bosch affiliates’ mobile applications, products and services, including, without limitation, to authenticate users, process payments, provide requested services, provide optional additional services and to develop new features, products and/or services

• providing customer service

• providing additional offers and/or opportunities to the Pilot Participant and its affiliates

• product and/or service surveys

• responding to submitted inquiries and customer service requests and other questions and/or comments

• for the U.S., this data may be used for marketing, analytics and all other purposes

• monitoring compliance with legal and/or regulatory requirements

5. Sharing of personal data

Bosch may use, store, compile, manipulate and share information collected about Pilot Participant and its Primary User and other Authorized Users, as described in this Privacy Statement, with the following entities and individuals, its and their affiliates, designees and assignees and otherwise as follows:

• Bosch affiliated entities, including Bosch’s parent company in Germany, Robert Bosch GmbH, and Robert Bosch Power Tools GmbH

• Bosch third party service providers, vendors, consultants, suppliers, licensors, marketing partners and other partners and entities performing work on Bosch’s behalf

• relevant authorities in accordance with, and as Bosch deems required, necessary and/or appropriate by, or in connection with, applicable law, regulation, court order or legal process

• to carry out or assist with Bosch obligations, desires and intents, and/or to enforce Bosch rights, duties, desires and intents arising from or in connection with any contracts entered into between you and Bosch or any third party under contract with Bosch or any Bosch affiliate, or in connection therewith, including, without limitation, for monitoring, administrating, reviewing, critiquing, billing and/or collection

• if Bosch believes disclosure is required, necessary and/or appropriate to protect the rights, interests. property, business or safety of Bosch or any Bosch affiliate, or its or their employees, officers, owners, agents, representatives or customers, as well as its or their third party providers, contractors, suppliers, licensors or partners, or the public, or to enforce or apply the Terms of Use for the Pilot Website, available at https://propartner.boschtools.com/site/terms-and-conditions, or other agreements

• in connection with, or during negotiations of, any merger, sale of assets, consolidation or restructuring, financing or acquisition of all or a portion of any Bosch business, asset or opportunity by, with or into another business, entity or company

• in an aggregated and/or anonymized form which cannot reasonably be used to identify you; or

• otherwise, with your consent.

By accessing and/or using the Bosch websites, mobile applications, products and/or services, Pilot Participant consents to the above uses and sharing of its personal data in accordance with this Privacy Statement.

6. Collection and processing of non-personal data

When you access the Pilot Website, Bosch may also automatically collect the following non-personal data: the website from which you visit Bosch (referrer), pages viewed, files downloaded (downloads), individual links clicked, search words or search phrases (site search), duration of visit, browser used, mobile device data (e.g., unique device identifier, MAC address, IP address, serial number, hardware model, mobile network information and operating system and version) for your smartphone, and other relevant details and/or information. If the visit is a result of online advertising such as banners, video ads, search engine advertising, etc., Bosch or its agents, representatives, suppliers, vendors or consultants may record which banner, adword, etc. motivated or assisted with the visit to Bosch websites.

The insights gained enable Bosch to further optimize Bosch websites, mobile applications, products and services, and tailor them even better to customers’, visitors’ and/or users’ needs.

7. Registration Via the Central Bosch ID

Pilot Participant may register for Bosch online offers exclusively using the central Bosch ID. The centralized Bosch ID was devised by Robert Bosch GmbH for the Bosch group of entities and businesses (the “Bosch Group”) in order to allow for the joint users and customers to benefit from offers of different group companies using centralized application data and increase data safety.

Robert Bosch GmbH, Robert - Bosch - Platz 1 70839 Gerlingen - Schillerhöhe, Germany (“RBG”) is responsible for the provision of this single sign-on service.

If Pilot Participant wants to apply for a centralized Bosch ID, the General Terms of Use for the Registration and Use of a centralized Bosch ID and the Data Protection Notice of RBG shall apply.

After successful registration Pilot Participant may utilize the registration data used for the centralized Bosch ID also for registering for Bosch online offers. To this end, Bosch shall provide an RBG registration template for the centralized Bosch ID. RBG then shall confirm your authorization and provide Bosch with the master data required for using Bosch offers (e.g. surname, first name, date of birth, company name, email address, telephone numbers, mail address). Your password shall not be communicated to us.

Concerning further data transfers within the Bosch Group associated with the centralized Bosch ID, please refer to the Data Protection Notice. You may cancel your user agreement concerning the centralized Bosch ID at any time by unregistering. 8. Use of the Google Analytics web analytics tool

Bosch may use web analytics tools, such as the Google Analytics web analytics tool, to carry out access measurements. Some data which may be collected using the Google Analytics tool includes, without limitation, information about usage of Bosch Tools GPS functionality, approximate location, operating system, device-type and browser type.

Cookies are used for metrics to enable website usage to be analyzed. In particular, Bosch uses them to improve data quality, among other things. The information generated about the use of websites is transmitted to the statistics server (statse.webtrendslive.com) which is operated by Webtrends Inc., 555 SW Oak Street, Suite 300, Portland, OR 97204, United States (“Webtrends”) in the United States of America. Only authorized persons have access to this anonymized data.
